ASSUMPTION OF RISK, ACKNOWLEDGEMENT OF POLICIES, LIABILITY WAIVER AND HOLD HARMLESS AGREEMENT

Eight Little Boots, LLC (DBA Eight Little Boots Family Farms)

Upon entering the premise of Eight Little Boots Family Farms at 6045 Buffalo Rd Churchville NY 14428 and/or 7254 Dublin Rd. Bergen NY 14416, and participating and engaging in any agritourism activities, programs or events, including animal interactions and farm experiences, I, and all accompanying parties, agree to the following:

Guest Conduct Policy!

Our most important rules are - Be Kind, Be Respectful, Play Hard, Have Fun!

However, we do have some other specific policies we must enforce for the safety and integrity of our property in order to maintain a welcoming, family-friendly atmosphere.

By entering our farms, you agree to the following guidelines:

No pets

No smoking or vaping

No drugs or illegal substances of any kind

No entry under the influence of drugs or alcohol

You must dress and behave appropriately for a family-friendly environment

Children must ALWAYS be accompanied and supervised by their responsible adult

Responsible adult must assume FULL responsibility for their child’s safety and conduct while at our farm

You must follow ALL posted signage & verbal instructions for your safety and the safety of others

RESPECT all farm rules, staff, animals, visitors, toys, equipment, and property

Do not allow children to put toys in their mouth. Ensure that your child leaves toys in corresponding areas

Visitors MUST wash hands after any and ALL animal interactions AND upon leaving the farm facilities

If you see something hazardous while onsite, you must report it immediately

Stay in the designated public areas

No glass bottles or containers

Do NOT share your food with the animals

You may ONLY feed animals the specific feed purchased onsite

No food or drink inside the animal pastures

No entry outside of ticketed hours unless solely visiting the farm stand

Stay home when sick

We do not tolerate rough play, fighting, bullying or any harmful words or actions

Make GOOD choices

Be KIND and considerate

Failure to Comply?

We reserve the right to refuse entry or remove anyone, without refund, who is unwilling to follow these rules or verbal directions given by farm staff

If you witness or experience anyone breaking policy, it must be reported it immediately

Ticketing Policy!

Payment is required to enter

All ticket sales are final

Tickets are non-refundable, but we would be happy to help with an alternate date if an emergency arises

A waiver must be signed for each person entering the farm

You must exit the farm when your time is up or you will be charged for an additional visit

Guests who arrive late may forfeit their tickets

Children must always be accompanied and supervised by their responsible adult

In the event the farm must close, ticket holders will be able to reschedule or request a full refund

For group rate ticketing, pre-registration is required and tickets must be purchased together as a group.

Agritourism Risk Acknowledgment

By participating in any activity at Eight Little Boots Family Farms, I acknowledge and assume the inherent risks of participating in agritourism activities on working farms, as described in New York State Law Article 18-B, Responsibilities of operators and visitors of agricultural tourism areas, Section 18-303.

I acknowledge and understand that there are inherent risks associated with participating and engaging in Eight Little Boots, LLC programs, events or activities at Eight Little Boots Family Farms. Those risks could lead to injuries including but not limited to bruises, sprains, broken bones, serious injury, permanent disability, paralysis, or death, as well as property damage to me or others. These risks may result from a variety of circumstances including the misuse of equipment or facilities. I knowingly and freely assume all such risks, both known and unknown, including those that may arise out of the negligence of other participants.

I understand that this is a working farm and may have uneven pathways and grounds, animals, and equipment in use. I agree to comply with all posted signage and verbal instructions from farm staff. Eight Little Boots, LLC is not liable for injury, death, damage, or loss that occurs while participating in an agritourism activity conducted at our farm facilities.

By entering the facilities, I agree to not act in any negligent manner that may contribute to injury, death, damage or loss to myself or others. I understand that animals may act out and intentionally or unintentionally treat us in a negative way causing harm to our bodies. I agree to follow and listen to cues and verbal commands given by farm instructors. I agree to make good choices regarding the safety of myself, others, and the animals. I understand that animals may carry illness that can make people sick. I agree to wash hands thoroughly with soap and warm water after interacting with animals and leaving the farm facilities. 

I am assuming the risks by participating in agritourism activities at Eight Little Boots Family Farms.

Assumption of Risk

I am voluntarily engaging in activities as a participant and/or volunteer and I am choosing to use the facilities at Eight Little Boots Family Farms at my own risk. I understand that I am solely responsible for any medical, health, or personal injury costs relating to my visit at Eight Little Boots, LLC. I understand that children must always be accompanied and supervised by their responsible adult. I understand that I assume full responsibility for my child’s safety and conduct while at the farm. I represent that I am the parent or legal guardian of the participant(s) noted, or I have obtained permission from the parent/legal guardian of the participant(s) noted to execute this agreement on their behalf. I agree that the participant(s) and I shall comply with all stated in customary terms, posted safety signs, rules, and verbal instructions, as conditions for participation in any program, event or activity at Eight Little Boots Family Farms.

Acknowledgement of Rules & Policies

I acknowledge that I have read, know, and agree to all of the policies and procedures relating to the use of the facilities at Eight Little Boots Family Farms stated above in the Guest Conduct and Ticket Policy section.

I agree to comply with all rules, regulations, and policies at Eight Little Boots Family Farms. I understand Eight Little Boots Family Farms reserves the right to revoke or terminate my use of the facilities at for any violation of rules, regulations, or policies.

Privacy

Eight Little Boots, LLC respects your privacy and will not share your personal information with anyone

Notice of Filming and Photography

Eight Little Boots, LLC may use the collection of media throughout public areas of the property, including but not limited to, photographs and video footage depicting visitors at Eight Little Boots Family Farms without the expressed written and/or oral permission of those included within the media. Eight Little Boots, LLC holds the right to photograph or record on the installed video surveillance system and/or any personal mobile devices.

When entering Eight Little Boots Family Farms, you consent to photography and video recording and the release, publication or reproduction to be used for advertising, television or radio broadcast, promotional purposes, including on the website of Eight Little Boots, LLC and social media profiles, or any other purpose, without compensation.

Liability Waiver and Hold Harmless Agreement

With the full understanding of the risks stated above, I hereby release, waive, discharge, and hold harmless Eight Little Boots, LLC from, without limitation, any and all claims, actions, suits, procedures, liabilities, judgments, costs and expenses (including but not limited to medical expenses and legal fees), which are in any way connected to participation and engagement in any activity at Eight Little Boots, LLC on behalf of myself and any minor child/children for which I am the parent, legal guardian, or responsible adult. Furthermore, I release and agree to indemnify Eight Little Boots, LLC from any claims for any property damage, loss or theft, personal injury or illness, death, or other loss as a result of or arising out of the involvement in events, programs or activities at Eight Little Boots Family Farms.

I hereby acknowledge that I have carefully read and fully understand this Assumption of Risk, Acknowledgement of Policies, Liability Waiver, and Hold Harmless Agreement.

I fully and voluntarily agree to all terms and conditions in this agreement. I hereby certify that I have the authority to sign on behalf of the children noted.
